A California couple’s surrogate gave birth in Texas on Wednesday, amid a legal dispute over medical treatment for the newborn, who was diagnosed before birth with a life-threatening heart condition.
The birth came one day after a Dallas judge ordered doctors to provide life-sustaining care to the baby, who has hypoplastic left heart syndrome, a serious congenital heart defect.
According to an attorney representing surrogate mother McKenna West, the newborn was receiving stabilizing treatment and was scheduled to undergo surgery at a Texas hospital.
The case has attracted national attention, with right-to-life groups and Republican officials supporting West. Texas Attorney General Ken Paxton intervened in the case and backed the request for medical treatment.
West has accused the California couple, Omar Ahmed and Nausheen Gilkar, of wanting to end the pregnancy after doctors discovered the baby’s heart condition. However, the couple has denied in court filings that they intended to refuse surgery after the child was born.
The couple’s attorney, Lee Budner, said the baby was receiving medical care and accused West and Paxton of turning a family tragedy into a political dispute.
He said the parents’ priority was ensuring their baby received the medical treatment needed while allowing them to spend time with their newborn.
The legal dispute continues as the baby receives treatment and prepares for heart surgery in Texas.
