Israel’s Supreme Court has ruled that authorities must allow representatives of the International Committee of the Red Cross (ICRC) to resume visits to Palestinian detainees held in Israeli prisons, overturning a government policy imposed after the October 2023 Hamas-led attack.
In a unanimous decision issued on Wednesday, the court found that the ban on Red Cross visits violated both Israeli and international legal obligations. The judges ordered the government to revoke the restriction and restore access for the humanitarian organization.
The ruling also stated that the government failed to provide a sufficient legal basis for suspending all prisoner visits following the October 7 attack, which left more than 1,100 people dead and over 240 taken captive.
The case was brought by several Israeli human rights organizations, including the Association for Civil Rights in Israel (ACRI), which argued that the prohibition marked the first time in five decades that Israel had blocked Red Cross access to Palestinian prisoners.
According to rights groups, the decision will allow the ICRC to resume visits to more than 9,000 Palestinian detainees held in Israeli prisons and military detention facilities.
The Red Cross welcomed the court’s decision and said it was prepared to restart its detention-related activities as soon as arrangements with Israeli authorities are finalized. The organization emphasized that access to detainees and private meetings with them are requirements under international humanitarian law.
The ruling comes amid increasing scrutiny of conditions inside Israeli detention facilities. Human rights advocates and international organizations have raised concerns over allegations of mistreatment and abuse of Palestinian prisoners during the ongoing conflict.
Observers say the court’s decision represents a significant legal reaffirmation of detainee rights and humanitarian access during periods of conflict.
