US Judge Rejects Bid to Block Trump’s New Birthright Citizenship Order

A US judge has temporarily rejected a request to block President Donald Trump’s latest executive order seeking to restrict birthright citizenship.

District Court Judge Deborah Boardman declined to immediately issue a preliminary injunction against the order, while expressing concern about its unprecedented nature. She instructed immigrant families and advocacy groups challenging the policy to revise their lawsuit to directly address Trump’s new order.

The groups can then seek the injunction again after filing the revised complaint.

Trump issued the new executive order on August 6, 2026, after his earlier attempt to restrict birthright citizenship was struck down by the US Supreme Court.

Birthright citizenship is protected by the 14th Amendment, which generally grants US citizenship to people born on American soil, regardless of their parents’ nationality or immigration status.

Trump’s latest order seeks to exclude certain children from automatic citizenship, including those whose parents are classified as “alien enemies” or “terrorists,” as well as children allegedly involved in arrangements designed to obtain citizenship through birth in the United States.

Immigrant rights organisations have condemned the order, arguing that the president does not have the constitutional authority to change birthright citizenship through an executive order.

The legal battle is expected to continue, with the plaintiffs preparing a revised petition seeking to temporarily block the policy.
