A Federal High Court in Kano has ruled that the Federal Road Safety Commission (FRSC) has no legal authority to operate on state and local government roads, declaring its enforcement activities on township roads in Kano unlawful.
Delivering judgment on Thursday, Justice M. S. Shuaibu held that FRSC officers exceeded their powers by stopping, questioning, and delaying motorists on Kano township roads in July 2025. The court found that the actions violated citizens' constitutional rights to personal liberty and freedom of movement.
The court granted the applicant's requests, issuing a perpetual injunction that bars FRSC officials from stopping or harassing motorists on Kano State roads without lawful authority. It also directed the commission to publish a public apology in a national newspaper and awarded the applicant ₦800,000 in damages and legal costs.
The case was filed by Kano-based lawyer Abba Hikima, who challenged the commission after he was stopped at an FRSC checkpoint on a township road. He argued that the commission's statutory powers apply only to federal highways and not to roads under the control of state or local governments.
The ruling is expected to spark discussions over the scope of the FRSC's enforcement powers across Nigeria.
